Effective July 18, 2026. These Terms govern use of AvianTrader. By creating an account or using member features, you agree to these Terms, the Privacy Notice, and the Marketplace Rules.
Eligibility and accounts
You must be at least 18 years old and legally able to enter a binding agreement. Provide accurate information, protect your credentials, keep account details current, and promptly report suspected unauthorized access. Accounts and seller privileges may not be transferred.
Marketplace role
AvianTrader provides publishing, discovery, communication, moderation, and reputation tools for independent users. AvianTrader is not ordinarily the buyer, seller, owner, transporter, veterinarian, regulator, escrow provider, or party to an ordinary member transaction. A badge, profile, listing, review, or verification outcome is not a guarantee of identity, legality, ownership, health, conduct, or transaction success.
Member responsibilities
- Provide accurate account, profile, listing, and transaction information.
- Use the service only for lawful, humane activity and follow the Marketplace Rules.
- Independently verify identity, ownership, species, health claims, permits, records, transport requirements, and legal eligibility before proceeding.
- Protect private information, communicate in good faith, and report suspected fraud or prohibited conduct.
- Arrange payment, inspection, transfer, taxes, and risk allocation directly unless a separate written agreement states otherwise.
Listings, moderation, and enforcement
Publication is discretionary. AvianTrader may review, hold, reject, edit for safety or clarity, archive, or remove content; restrict features; suspend or terminate accounts; preserve evidence; and cooperate with lawful investigations. Moderation does not create a duty to monitor every user or transaction. Members retain ownership of their content and grant AvianTrader a non-exclusive license to host, reproduce, format, and display it as needed to operate and promote the service.
Private brokerage
Brokered listings are separate from ordinary member listings and must be visibly disclosed. Brokerage services require a separate written agreement describing authority, fees, screening, disclosures, and responsibilities. These Terms do not create a brokerage relationship.
Disclaimers and limitation of liability
To the fullest extent permitted by law, AvianTrader is provided “as is” and “as available” without warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, or transaction outcome. AvianTrader is not liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for member conduct, animal condition, lost profits, lost data, or failed transactions. AvianTrader’s aggregate liability arising from the service will not exceed the greater of $100 or the amount you paid AvianTrader during the twelve months preceding the claim. Rights that cannot lawfully be limited remain unaffected.
Disputes, changes, and contact
Before filing a claim, contact AvianTrader and allow 30 days for an informal resolution attempt. Except for eligible small-claims matters or requests for emergency injunctive relief, disputes must be brought in a court with jurisdiction over AvianTrader’s principal place of business, and each party consents to that venue where legally permitted. These Terms are governed by the laws applicable at that principal place of business, without regard to conflict-of-law rules. AvianTrader may update these Terms prospectively by publishing a new effective date; continued use after notice constitutes acceptance. Questions may be submitted through Contact AvianTrader.
